The final hearing to appoint a permanent manager for the property known as Charles Cross Apartments took place on Thursday 5th December 2019.  At this hearing Judge D Agnew appointed Mr Donald Gerrard of Freehold Management Services Ltd (FMS) to be the Court Appointed Manager from that date for a period of three years.  Once the Court Order (Determination) is received at the offices of FMS  it will be immediately posted to this website and forwarded to all leaseholders via Royal Mail.

Following the sad and sudden death of Mr James Short, who was the sole director and shareholder of CX Freehold Ltd & Full Circle (Plymouth) Limited, an emergency application was made to the First-Tier Tribunal Property Chambers (Residential Property) under section 24 of the Landlord and Tenant Act 1987 for the appointment of an interim manager to urgently take control of the freehold known as Charles Cross Apartments.

 

Judge Tildesley OBE made an order dated 22 July 2019, which saw myself, Donald Ian Gerrard of Freehold Management Services be appointed as the interim manager, so that I may deal with the immediate issue of buildings insurance and any other day to day management issues which require urgent attention.  I therefore, have very limited powers nor authority to provide full management of the building.

 

The tribunal has restricted my appointment until 19 September 2019 and will review whether the interim appointment should continue beyond that date at a hearing on 5 September 2019.

 

Presently, I don't have any property or financial information relating tot he running of CX Apartments and therefore, I will be unable to answer any questions or concern's you may have with regards to any service charge payments that may have already been paid to either CX Freeholds Ltd or their managing agents, Full Circle (Plymouth) Limited.

 

Interim Demand:

Regrettably, I am unaware nor confident of any monies being held in what was your service charge account that was managed by either CX Freeholds Ltd or their agents, Full Circle (Plymouth) Limited and therefore, I find myself in a position whereby I hold no funds to be able to manage your property and more importantly, to put the building under insurance cover. Therefore, as directed by the Tribunal Judge, I have issued an interim service charge demand for the sum of £350.00, which I would be obliged if you would be kind enough to settle as soon as possible. For online bank transfers the account details can be found at the bottom of the demand and for ease of reference are also detailed later on in this letter.

Mr James Short (Deceased) - Family

I have had a number of productive meetings with the family’s representative and further meetings are scheduled. The representative has assured me that they will co-operate with the Courts and FMS as best they can. I would therefore, kindly request that no communication is attempted with the family and any concerns, questions etc are addressed to my office.

Conclusion:

Please be assured there are many agencies, including FMS that are working extremely hard on behalf of the leaseholders at CX Apartments. Whilst acknowledged, there is no quick fix, it will take a considerable amount of time for this building to be once more on an even keel and managed correctly in accordance with current legislation.

To that end, your understanding, patience and support will be greatly appreciated by all concerned.
